Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the MyLOA platform, including our website, mobile applications, SMS and voice services, and any related services (collectively, the "Service") provided by MYLOA INC, a Delaware C-Corporation ("MyLOA," "we," "our," "us"). By using the Service, you agree to these Terms and our Privacy Policy.

2. About MyLOA

MyLOA is a technology platform that provides AI-powered mortgage operations infrastructure to licensed mortgage lenders, mortgage bankers, credit unions, and individual loan officers ("Lender Tenants"). MyLOA is not itself a mortgage lender, mortgage broker, or loan originator. MyLOA does not make loans, approve loans, deny loans, set loan terms, quote interest rates, or recommend loan programs. All credit decisions and loan-related determinations are made by Lender Tenants and their licensed personnel.

3. Eligibility

You must be at least 18 years old and a resident of the United States to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate, complete, and current.

4. Your Account and Communications

If you contact MyLOA via SMS, voice, email, or other channel in connection with a loan application, you authorize us to communicate with you on behalf of your Lender Tenant through the channels you have used or otherwise expressly consented to. You may withdraw consent at any time as described in our SMS Consent page or by contacting us.

5. Interaction with AI

The Service uses artificial intelligence to assist with collecting, organizing, and routing your loan application information. When you interact with the Service:

• The AI will identify itself as an AI assistant at the start of every interaction
• The AI does not make credit decisions, approve or deny loans, name specific loan programs, or commit your Lender Tenant to any loan terms
• All decisions about your loan are made by your Lender Tenant's licensed personnel
• The AI may make mistakes; your Lender Tenant's licensed loan officer reviews and validates information before any loan decision

6. Recording of Communications

Voice calls and SMS messages with the Service may be recorded for quality, compliance, and audit purposes. You will be informed at the start of each voice call that the call may be recorded. By continuing the call after notice, you consent to recording. If you do not consent, you may end the call. Recordings are stored securely and used consistent with our Privacy Policy.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or to facilitate any unlawful activity
• Provide false, misleading, or fraudulent information, including in your loan application
• Impersonate another person or misrepresent your relationship with another person
• Attempt to circumvent any security measures, access controls, or technical limitations of the Service
• Reverse-engineer, decompile, or extract the source code or models underlying the Service
• Use the Service to harass, abuse, or harm another person, including our personnel
• Use automated tools to interact with the Service except as expressly authorized by us
• Resell, sublicense, or commercialize the Service without our written permission

8. Intellectual Property

The Service, including all software, models, designs, content, and trademarks (including the MYLOA mark, USPTO Serial No. 99745973), is owned by MyLOA or its licensors and is protected by U.S. and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain ownership of the personal information and documents you provide.

9. Third-Party Services

The Service relies on third-party providers including telecommunications carriers, AI infrastructure providers, credit bureaus, verification services, and cloud hosting. We are not responsible for the acts or omissions of third-party providers, but we do require contractual safeguards consistent with applicable law.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. MYLOA DOES NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

MYLOA IS NOT A LENDER. MYLOA DOES NOT PROVIDE LEGAL, FINANCIAL, OR TAX ADVICE. INFORMATION PROVIDED BY THE SERVICE IS NOT A SUBSTITUTE FOR ADVICE FROM A LICENSED LOAN OFFICER, ATTORNEY, OR FINANCIAL ADVISOR.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYLOA AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to indemnify and hold MyLOA harmless from claims, losses, and expenses (including attorneys' fees) arising from your breach of these Terms, your violation of law, or your fraudulent or false statements in connection with a loan application.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms. You may stop using the Service at any time. Upon termination, the rights and obligations that by their nature should survive termination (including intellectual property provisions, disclaimers, limitation of liability, and indemnification) will survive.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the email or phone number you have provided or via a notice on our website. Continued use of the Service after the effective date of updated Terms constitutes acceptance.
